Dog breeder took back pooch from Manhattan owner, resold it: lawsuit



A Manhattan woman was duped by a dachshund dealer, who sold her a pooch, borrowed it for breeding and then turned around and resold it to someone else, she claims in a new lawsuit.

Sydney Saltzman bought the female pup from Orange County breeder Doreen Biasi in October for $2,000 — a $6,000 discount — in exchange for Biasi keeping breeding rights for five years, Saltzman’s Manhattan Supreme Court lawsuit explains.

Saltzman received the dog — which she named Orly — in November, and by Jan. 29 lent Orly to Biasi for breeding, the court documents say.

“After taking possession of Orly, defendant unilaterally repudiated and willfully refused to continue to adhere” to their agreement, Biasi told Saltzman by email, according to the suit.

Biasi wouldn’t return Orly to Saltzman in an “underhanded scheme of selling Orly twice” despite knowing the bond and connection that Saltzman and Orly formed from their months together, the court papers allege.

While the court papers don’t indicate what reason Biasi gave Saltzman for not returning Orly, they do say it was a “mere pretext to justify her repossession of Orly in order to make a profit selling guardianship rights to another party,” the court filing alleges.

Saltzman says she had been properly taking care of Orly’s health and discipline “since the moment she undertook the responsibility of raising and owning Orly,” the court papers say.

“Defendant’s conduct constitutes extreme and outrageous behavior that shocks the conscience, inasmuch as she took possession of plaintiff’s beloved pet under false pretenses, then concocted a reason to retain her and re-sell her for her own pecuniary gain,” the suit charges.

Saltzman has brought claims against Biasi for breach of contract, unjust enrichment and intentional infliction of emotional distress.

She is suing for $35,000.

Biasi did not immediately return messages seeking comment.
